The maker of Barbie dolls and many more toys, Mattel, has abandoned its claim that a rival toy maker, MGA, had infringed on its copyright by developing Bratz dolls but have appealed against a $172 million award in damages for misappropriation of trade secrets and a $137 million award for MGA’s attorney fees and defence costs.

This is yet another court outing for the companies involved in an eight-year legal ping-pong match; that started in 2004.

Isaac Larian, the CEO of MGA, was pleased with Mattel’s decision not to further challenge the ruling on copyright infringement and said: “Bratz and its ownership has always belonged to MGA and was built with the hard work and ingenuity of MGA employees … I am confident we will prevail upon appeal.”

Although a federal jury returned a favourable verdict for Mattel in a 2008 copyright infringement trial (awarding Mattel $100 million in damages), this verdict was overturned on appeal and a second jury, last year, returned a verdict in favour of MGA on the copyright issue.

The same jury was also considered allegations that Mattel sent spies to toy fairs and trade shows to steal MGA’s trade secrets. Jurors found that Mattel stole 26 of the 114 trade secrets MGA listed, awarding $85 million in damages. The presiding federal judge awarded an additional $85 million in punitive damages and a further $137 million in legal fees.

In court papers filed this Monday, Mattel argued that MGA’s lawsuit on trade secrets was filed too late and therefore should not have been included in the trial, that the court abused its discretion and that errors were made calculating MGA’s attorney fees and defence costs.

This could go on to the point where someone finally goes Lalaloopsy.
